1. Parties

This Agreement is entered into by:

• Sinecera Care, LLC (“Company”)

• The undersigned Neighbor Driver (“Driver”)

2. Nature of Relationship

Driver acknowledges and agrees:

• Driver is engaged as an independent contractor, not an employee

• Driver is not entitled to employee benefits, workers’ compensation (unless required by law), or tax withholding

• Driver retains control over when and whether to accept service requests

3. Scope of Services

Driver may provide:

• Non-medical transportation for seniors

• Accompaniment into and out of locations

• Errand and appointment support

Driver agrees NOT to:

• Provide medical care or advice

• Perform heavy lifting or unsafe physical transfers

• Represent themselves as a healthcare provider

• Transport clients in unsafe conditions

4. Driver Eligibility Requirements

Driver certifies that they:

• Hold a valid U.S. driver’s license

• Are at least 21 years of age

• Have at least 3 years of driving experience

• Have a driving record that meets Company standards

Driver agrees to notify Company immediately of:

• Any license suspension or restriction

• Any moving violations or accidents

• Any criminal charges that could impact safety

5. Vehicle Requirements

Driver agrees that any vehicle used:

• Is owned or legally authorized for use by Driver

• Is properly registered and insured

• Is maintained in safe operating condition

• Meets basic safety standards (tires, brakes, lights)

• Is clean and appropriate for transporting seniors

6. Insurance Requirements & Certification

Driver agrees to maintain active personal auto insurance with minimum coverage of:

• $100,000 bodily injury per person

• $300,000 bodily injury per accident

• $50,000 property damage

Driver further agrees:

• Their personal auto insurance is primary coverage for any incident

• They are responsible for confirming their policy permits use for this type of service

• They will provide proof of insurance prior to providing services and upon renewal

Driver understands that:

• Company may maintain non-owned auto liability insurance, which is secondary

• Failure to maintain required insurance may result in immediate suspension

7A. MVR Certification & Limited Use of Vehicle

Driver certifies and agrees to the following conditions as a requirement of participation:

Motor Vehicle Record (MVR)

• Driver maintains a clean Motor Vehicle Record (MVR) with no disqualifying incidents

• Driver authorizes Sinecera Care to:

  • Obtain an MVR report prior to approval

  • Conduct annual MVR checks

• Driver agrees to immediately report:

  • Any accidents

  • Any moving violations

  • Any license suspension or restriction

Limited Business Use

Driver agrees that:

• Use of their personal vehicle for Sinecera Care services is occasional and incidental only

• Such use will not exceed 20% of total driving time

Non-Commercial Transportation Representation

Driver certifies that:

• They do not regularly transport passengers or goods for compensation outside of Sinecera Care

• They are not operating as a:

  • Taxi service

  • Rideshare driver (e.g., Uber/Lyft) while providing Sinecera services

  • Delivery or commercial transport provider during Sinecera engagements

Compliance Acknowledgment

Driver understands that:

• These conditions are required to align with Sinecera Care’s insurance coverage

• Violation of these conditions may result in:

  • Immediate suspension

  • Termination from providing transportation services

7. Safe Driving & Conduct Requirements

Driver agrees to:

• Obey all traffic laws

• Refrain from texting or handheld phone use while driving

• Ensure all passengers wear seatbelts

• Drive defensively and prioritize passenger safety

• Provide reasonable assistance entering/exiting vehicles

Driver agrees NOT to:

• Drive under the influence of drugs or alcohol

• Engage in reckless or distracted driving

• Transport clients if feeling unfit to drive

8. Weather & Safety Discretion

Driver has the right and responsibility to:

• Decline or cancel trips due to unsafe conditions (weather, road hazards, personal safety concerns)

Driver agrees to notify Company and Client promptly in such situations.

9. Incident Reporting

Driver must report immediately:

• Any accident (regardless of severity)

• Any injury involving a client

• Any vehicle damage during service

• Any interaction with law enforcement during service

Driver agrees to submit a written incident report within 24 hours.

10. Assumption of Risk by Driver

Driver acknowledges that providing transportation services involves risks, including:

• Motor vehicle accidents

• Physical injury during assistance

• Exposure to unpredictable situations

Driver voluntarily assumes all such risks.

11. Release of Liability

To the fullest extent permitted by law, Driver agrees to release and hold harmless:

• Sinecera Care, LLC

• Its owners, officers, and representatives

from any claims arising out of:

• Driver’s operation of their vehicle

• Driver’s actions or omissions

• Any incident occurring during transportation services

except in cases of gross negligence or willful misconduct by the Company.

12. Indemnification

Driver agrees to indemnify and hold harmless Sinecera Care from any claims, damages, or losses arising from:

• Driver’s failure to maintain required insurance

• Driver’s negligent or unlawful operation of a vehicle

• Breach of this Agreement

13. No Guarantee of Work

Driver understands:

• There is no guarantee of service requests or income

• Participation is voluntary and on a per-engagement basis

14. Compliance with Laws

Driver agrees to comply with all:

• Federal, state, and local laws

• Traffic and vehicle regulations

• Insurance requirements

15. Term & Termination

This Agreement may be terminated:

• By either party at any time

• Immediately by Company for safety, compliance, or policy violations

16. Acknowledgment and Agreement

By signing below, Driver acknowledges that they:

• Have read and understood this Agreement

• Meet all requirements stated herein

• Agree to comply with all policies and standards
